Different Types of KY Titles

7 X 8 Kentucky Title that was printed before 2.28.00

   

 Complete the “assignment of title” on the back of your Kentucky title. Complete the seller and buyer section of the Application for Kentucky Certificate of Title/Registration TC96-182.  This form has the Total Consideration Affidavit used for computing usage tax incorporated into the form. The Vehicle Identification Section along with the Seller and Buyer information should be completed and signed by both parties. All signatures must be notarized.


8.5 X 11 Kentucky Title that was printed between 2.28.00-8.4.2016 (Black border)

 

Complete the “assignment of title” on the back of your Kentucky title. Complete the Application for Title/Affidavit of Total Consideration on the back of the title. Complete the seller and buyer section of the Application for Kentucky Certificate of Title/Registration. Note: Both signatures of the seller (transferor) and buyer (transferee) are required to be notarized. Title has two sections for the seller(s) signature to be notarized by attesting official. Title has two sections for buyer(s) signature. Buyer(s) signature must be notarized on the right side portion of title under Application for Title/Affidavit of Total Consideration in buyer(s) section.

Complete the “assignment of title” on the back of your Kentucky title. Complete the seller and buyer section of the Application for Kentucky Certificate of Title/Registration. Complete the Application for Title/Affidavit of Total Consideration on the back of the title. Note: Complete the seller and buyer section of the Transfer of Title by Owner. Both signatures of the seller and buyer are required to be notarized.  


 

Required paperwork: 

      • Original title (no photocopies)
      • Proof of current KY insurance (not needed on trailers)

How to complete a transfer from one Kentucky individual to another Kentucky individual: 

Procedures will depend on the ‘age’ of your title. Follow the directions under the heading that best describes the Kentucky title that is being used to process your transfer of ownership. 

General Information

 The seller should sign his/her name on the back of the title exactly as it appears on the front. The seller’s signature must be notarized on the back of the title. In the case of an older title not having a notary field, the seller’s signature would then be notarized on the Application for Title. In cases of joint ownership – ‘or’ requires just one signature – ‘and/or’ either signature, ‘and’ requires both signatures. The correct odometer reading is required. The Title and VTR may be completed and notarized outside the County Clerk’s Office. In such cases anyone may bring the paperwork in for processing.

If the buyer or seller’s signature is notarized by the County Clerk’s Office, the person must appear in person with a valid picture I.D.

In processing any transfer proof of Commonwealth of Kentucky insurance is required.

Proof of insurance provided must be in the name of the buyer at the time of transfer. If there is going to be two names on a title at least one of those names must be listed as an insured driver on the insurance card. If you provide the Clerk’s Office an insurance card as proof of insurance, the card cannot have an Effective/Issue date older than 45 days from the date that it is presented. It is important to note that the effective date of the policy may be different than the effective date of the insurance card. For acceptance the Clerk’s Office is concerned with the date the card was issued, not the policy. This applies to Personal Policies only. The buyer must provide proof of current KY insurance on the vehicle being transferred. Original card must include name, effective date, vehicle identification number (VIN), NAIC number, Commonwealth of Kentucky policy number and expiration date. Fees

    • Transfer fee – $17.00 (when transferring title and plate)
    • Title Only Transfer fee -$9.00 (transferring title only, no plate or if there is a plate it must be turned in at the time of transfer)
    • Usage tax is generally based on 6% of purchase price when transferring a KY title (some KY titles may require a TC96-182).  

Some situations where the sales/usage tax may not be based off the purchase price are:

  • If the vehicle is less than 20 years old and has a clean title then the state will require the taxes be based off of the “floor” price which is half of the clean trade in value the vehicle.
  • If it is a transfer that falls under one Motor Vehicle Usage Tax Multi-Purpose Form Exemptions (i.e. PARENT/CHILD, SPOUSE/SPOUSE, GRANPARENT/GRANDCHILD) then it will be tax exempt.
  • If it is a older small KY title and the TC96-182 form is not completed then taxes will be based off of 6% NADA Retail Value.
  • If it is an older full size KY title and the seller has signed and notarized it at the top portion of the title but not the bottom then taxes will be based off of 6% NADA Retail Value.
  • If it is a transfer of a historic vehicle the taxes will be based off 6% of $100.00.
  • If it is a transfer involving a Will, Court Order, Divorce Decree/Separation Agreement it depends on the way the documents read but if the Court Order or Will Exemption applies then taxes will be based off of $100.00.
  • If it is a transfer when you are removing or adding a name and they are NOT related to you taxes will be based off of 6% NADA Retail Value. 

Any delinquent tax on the vehicle being transferred must be paid before transfer. Any delinquent tax on other vehicles owned by the purchaser must be paid prior to transfer. The license plate must be current in order to transfer the vehicle unless it is being surrendered at the time of transfer for a title only.

 

Accepted methods of payment are cash, money order, MC, Visa, AMX and Discover or personal check. No out-of-county checks accepted. Valid picture ID is required for acceptance of personal checks.
